(1) Notwithstanding anything written elsewhere in this Act, if a civil servant dies due to conflict in the course of performing the duties assigned by the Government of Nepal, if the term of office of such an employee is less than twenty years, then the remaining period shall be added to his/her husband or wife for life as per this Act.
(2) A person receiving pension as per sub-section (1) shall not receive family pension or gratuity as per section 39.
(3) If a person who gets pension according to this section marries another person, he will not get such pension.
(4) When the salary of the incumbent civil servant is increased, two-thirds of the increase in the initial salary will be added to the family pension amount received by the person receiving pension according to this section.
(5) In case of the death of a person receiving pension according to this section or if he remarries, the amount of such pension shall be received as prescribed until the deceased employee has minor children.
